ENFORCE LAWS WITH WILL: CHAIRMAN LAW COMMISSION

PHD Chamber of Commerce and Industry on Wednesday organized a Seminar on Pharma & Healthcare Sector-Legal Issues in which Chairman, Law Commission of India, Justice Dr. B S Chauhan was the inaugural addressee with host of medical professionals being the panellists such as Chairman & Head of the Department-Nephrology & Kidney Transplant Medicine, Max Super Specialty Hospital, Dr. Dinesh Khullar; Director & Head of Neurointerventional Surgery, Artemis Hospital, Dr. Vipul Gupta and MS, FRCS, FICS, FAIS Dr. Harsha Jauhri.

Chairman, Law & Justice Committee, PHD Chamber, Mr. Vipul Maheshwari and its Secretary General, Mr. Saurabh Sanyal were also among others who expressed their views on the pharma and healthcare sector with legal perspective.

Justice Chauhan in his observations felt that laws should be made and enacted with sufficient representation of all concerned and that their intent should be extremely objective so that their misrepresentation is plugged.

According to him, the society as a whole should have the acceptability of the laws enacted and the executives have sufficient enforcement will for the laws to be enforced.  Justice Chauhan cited the case of Sati abolition in India many decades ago, reminding that it could be enforced because the executive at that point had the intention to do so.

The panel of Doctors whose names have been given above demanded that the laws in India should not be unwise as on account of this, the doctors while rendering their duties are sometimes held guilty and even convicted in the name of medical negligence.

The Seminar concluded with a positive note that the enactment of the laws should be done with chased and pious intention and their enforcement should be strict without being biased.

Ends.
